DAMAGES AWARDED.
UNJUSTIFIABMS ASSAULT. AUGJvLANL), Septemlwr 8. Mt Justice* Herdman to-day awarded £75 each to Lcighton Hill and Geoffrey Goodwin, of Wellington, who claimed damages from the Auckland Automobile liaciHg Club and Henry Janjes Batcher, its chairman of directors, alleging that they were assaulted by Butcher and his employees on Ninety Mile 'Beach. Tlvjy claimed £250 each as general damages, and £143 special damages. After hearing counsel to-day, tlje judge said that there was no doubt that tho plaintiffs had been the. victims of unjustifiable assault. The company would ha,ve to accept responsibility lor Butcher's actions, as he was. acting in the company's interests. Plaintiffs had npt proved actual loss to justify the award' of special damages. The position regarding general damages was altogether different, continued the Judge. No man had the right to take the (aw into pis own hands. In this case he thought it unnecessary to award punitive damages. Plaintiffs had suffered no physical injury, and their reputations had been vindicated.
