TIMARU AND SOUTH CANTERBURY NEWS

TIMARU. WOOL SALES. The South Canterbury "Woolbrokers' Association received- advice yesterday from the president of the New Zealand Woolbrokers' Association that Timaru had been granted a wool sale on December 16th. The auction will be held at night, commencing at 7 o'clock. The Duncdin sale is fixed for December 20th. Appeal Dismissed. The appeal of Joseph Perry Eosevear, against his conviction by Mr C. E. On- Walker, S.M., on a charge of driving an unregistered motor vehicle, has been dismissed by Mr Justice Adams in a reserved judgment. The appeal was on a point of law. 'The facts were that appellant, an employee of the Colonial Motor Co., Ltd., drove a new lorry, bearing demonstration plates to Ashburton to deliver it to a purchaser there, and had carried on the lorry some drumß of oil and spare parts for which the Colonial Motor Co. was a dealer, for delivery to the firm which bought the lorry. His Honour held that the Magistrate had correctly construed the Act. The carrying and delivery of oil and spare parts of motor vehicles was not within the authority given to use the vehicle by Section 18 as amended. The Section as first enacted limited that use to "purposes of sale" only. The amendments extended this not to the purposes of the owner's business but to the owner's business as a manufacturer of or dealer in motor-cars. Notwithstanding " the ingenious argument of counsel for the appellant his Honour held that the extensions applied, not to the business of tho owner, but only to those departments of his business which consisted of manufacturing motor vehicles or dealing in motor vehicles. Upon any reason able construction it could not be extended to dealing in motor "ils or •pare parts of motor vehicles. The appeal was dismissed with costs. Bugby TJnion. George Lancelot Tempieton, father of the child, gave evidence of identification. He said the child was. six weeks old. On the night before its death the child had been placed next to the wall, beside its mother. The child had been vef»y restless. At about 7 a.m: on Monday h e awoke and later found the child dead in bed. To the Coroner, witness said he had two other children. It was not his custom to have the children in bed, and td his knowledge the child had never been in bed with his wife before.. The child, had been taken to bed on that particular occasion because it was not well. Details of the child's condition when found were given by Dr. A. S. McInnes, who said had conducted a postmortem examination, which revealed ihe cause of death to .be asphyxiation. A verdict in accordance with the medical evidence was returned. "The evidence for itself," said the Coroner, "and there is no need for me to comment on the danger of the practice of mothers taking babies to bed. It seems strange that intelligent mothers should persist in the habit."
