BOOKMAKER CONVICTED. (press association telegium.) DANNEVIRKE, September 8. Mr J. Miller S.M., to-day fined Frederick Schlitzkus, otherwise known as Frederick Slater, £3O on a charge of bookmaking. A charge of keeping a common gaming house, to which accused also pleaded guilty, was with drawn by the police. The prosecution was tho sequel to .a raid on . his premises. Sergeant Martin said accused came to Dannevirke in September last, and commenced bookmaking, taking up the business carried on by a former bookmaker. He had been carrying on business as a bookmaker fairly extensively, his ramifications, according to the evidence found in his possession, extending even to the turf 111 Australia. On the day in question, with the assistance of three constables, Sergeant Martin said the premises occupied by Slater were raided, where they found ample evidence of bookmaking being carried on extensively. So far as the police were aware, accused had never bfeen previously before the Court. Mr T. H. G. Lloyd, for accused, said defendant was CO years age, and previous to coming to Dannevirke had been workin. for the firm of C. H. Slater and Co. Two years ago Slater broke a lee. iind as a result had ;been in hospital for five months. He was out of work for twelve months, and consequent k on his accident had

been unable to resume his former calling as a storeman. He came to Dannevirke twelve months ago. and started bookmaking in a small way, but as a result of his operations, lost heavily. Counsel handed in accused's bank book to the Magistrate. Proceeding,- council said that whatever penalty was inflicted, accused would have to ask for time for payment, because- he had not the money to pay. He would have to borrow it. He would ask-his Worship to take this into consideration when fixing the penalty, and the fact that he had lost heavily and, being unable to follow his ordinary avocation as a storeman. had been compelled to take on the precarious caljing of bookmaking to earn a • livelihood. _■ The Magistrate asked if both charges arose out of the same set of circumstances. Sergeant Martin replied that that was so. and he did not press for a conviction on both charges, only on the major charge of bookmaking. The Magistrate said, according to the statement of Sergeant Martin, the ac-. cused had been carrying on the business of bookmaking very extensively,, and_ according to Mr Lloyd prior to coming to Dannevirke he had been in regular employment until he met with an accident. The Act looked upon these offences very seriously, and provided for a severe > penalty. Taking all the circumstances into consideration he thought the case. would be met if he were to fine accused £3O on the bookmaking charge. The charge in respect to the alleged keeping of a gaming house would be struck out with the consent of - the police. Accused was allowed one month m which to pay the fine, and to report to the police twice daily. An order was made for. the confiscation of all betting material found in the possession of accused.
