AWARD OF DAMAGES.
MOTION TO UPSET VERDICT. (JBE3S ASSOCUrIOJr TELEO*U£.) WELLINGTON, July 18. The Full Court to-day is considering the case of O'Connor v. the Kelson Moate Tea Co., Ltd. In tho Lower Court, O'Connor was awarded' £IO2O damages through falling down a lift, well in Wellington. Defendant moved for a non-suit, or for judgment, or for a new trial, and plaintiff moved for judgment. These motions were removed into the Pull Court. The questions for the Court are: What duty (if any) did the Nelson Moate Tea Co., Ltd., owe to O'Connor, and what was the nature of the permission (if any) givein to O'Connor in respect of the übo of the lift. Mr C. P. Skerrett, with Mr H. O'Leary, for the defendant company, contended that there was no legal nexus between the plaintiff and the defendant company, and further that the plaintiff, even if he had defendant's permission to use the lift, had permission to use it oniy in the natural and customary way, without negligence, which he had not done. Mr P. J. O'Regan appeared for the plaintiff.
