(PRESS ASSOCIATION TBLEGBtM.J WELLINGTON, March S. An application was made to the Arbitration Court this morning by the national dispute committee of waterside labour for consideration of - its interpretation of the clause governing the payment of oil rates to top men and men in trucks, on the ground t material evidence was now available which was not submitted to the Court at the time' when the previous application for interpretation was made. Mr Bennett, for the employers, said •it was understood by those who' drew up the original claims on behalf of the employees that the employers desired that the men handling a less quantity than 150 cases of kerosene or benzine below the hatches should not receive the oil rate. Having l regard, to this intention the employers' representative agreed, when the dispute first, came before the national committee, with/ the waterSiders' oontentlon that tie top men and the men on the wharves and trucksshould receive oil rates. The Court upnet the decision of the committee and denied the top men the oil rate. The employers had no intention of depriving them, of'the oil tate. The Judg« said the' Court could not amend the award without the .consent of -both pairties and if all agreed to. the alteration and submitted, a properly worded clause the Court would consider it.

COOKS AND STEWARDS.

AN UNUSUAL APPLICATION. (press association telighau.) WELLINGTON, March 5. An unusual application was made to the Arbitration Court to-day by Mr E, Kennedy for permission to appear in the seamen's dispute proceedings on . behalf of the Cooks' and Stewards' Union lest it be prejudiced by clauses in the seamen's award. Mr W. G. Smith, employers' representative, objected, on the grounds that if permission were given, chaos would result. Such permission -would establish a precedent for the appearance of other unions indirectly concerned in the maritime industry. After a retirement his Honour, Mr Justice Frazer, said that the clause in the Act waß intended to give representation to unregistered bodies such as gpilds. The cooks and stewards were working under separate awards, and. were regarded, as- workers in separate industries. 'lhe Court did not consider that stewards were likely to be prejudiced by a new award for seamen. The Court would guard against this. XUe application was declined.

Unionists repairing the vessel have stopped work, and decline to resume unless an undertaking is given that extensive .repairs, which they declare necessary, are finished oy unionist labour. The Trades Hall contends that the repairs done are inadequate, and only enough to cirry the vessel to JKobe, where it would be necessary to spend large sums in Thoroughly repairing her.
