THE HAYNES ESTATE.
EXTRA DUTY TO BE PAID. (PBESS ASSOCIATION TELEQBAM.) DUNEDIN, March 4. Mr Justice Sim gave judgment to-day in the Supreme Court in the action in which the Commissioner of Stamps claimed from the executors of the will of the late Daniel Haynes £8414 Is -15 alleged to be due for death duties. The items in dispute between the parties were:— (1) A debenture for £47,497 los Id given by Kerbert Haynes and Co. to the testator, this including a sum of £1533 5s 2d, for accrued interest, was valued by the plaintiff at £46,389 9s sd. In the statement furnished by the defendants this debenture, including accrued interest, was valued at £42 905 14s lid.
(2) Nine hundred shares of £IOO each in Herbert Haynes and Co., valued by plaintiff at £99,000, and by the defendants at £74.250.
(3) One thousand shares of £1 each in the Daniel Haynes trust valued by plaintiff at £13,250 and bv defendant at £5300.
His Honour concluded a lengthy judgment by stating that he considered a reduction of os per share should be made from the asset value of the shares and the value of shares fixed at £1 pershare. The assessment on this item would have to be reduced accordingly. Subject to this reduction, the plaintiff was entitled to judgment for the amount claimed with costs according to scale and disbursements and witnesses' expenses to be fixed by the registrar. The plaintiff was allowed £io 10s for the second day of the trial.
