Mr Upliftm appeared for the plaintiff and Mr Thomas for the defendant. Jajnes Erne3t Eulo, the plaintiff, said he had been in bueinepft as a. garage proprietor in Ashburton lor eight- . years. On October oth he was in the private office of th<> Asbbnrton Electric, Supply Company talking to Mr Barlow: Mclntyre cam© into the outer office and commenced, to enquire about aome batteries. He heard Barlow tell Mclntyrc if he wanted to know- anything about batteries to go to Rule's garage. Mclntyre paid: "Ask him! He would only tell me a lio. y Barlow' replied that" he had had a. lot .of dealings with Rule, and" had always found him «traig3it-. Bernard Frederick Barlow, manager, for tho Ashburton Electric Supply Company,' gave oorroborative evidence. , David James Mclntyre, • fl:e defendant, in his evidence denied having made uee of the words imputed to him. .While talking to Barlow in Barlow's, office he had said he would not go to Rule for a recommendation in 'respect to the battery if there -was not another man in New Zealand, and that if I he wanted'anvthmg- dpne to his car he -would j rather take it to Dunedin than take it to Rule.
