The interim judgment of Messrs Hunter. C. P. Skerrett, K.C., and E. A. Campboll, Racing Conference judge®, in the matter of tho svpeapls hv L. H. Hewitt, J. B. O'Shca, and E. C. Rac, jocksys, _ against the decisions cf the Auckland District Commit-!-09 in suspending their jockeys' lioer.ercs for , ib-i remainder of the ceuson, in connexion vith certain breaches of the Rules of Raciis as follows: — \ Vken tho judges met to hear tho above ::ppials, the secretary of the Racing Conferr.r.co placed before them communications f;om the appellants, in tbe.v ntat?d tLoir determination not 1o leave Auckland for tho purpose of attending the hearing' of tho appeals untii the judges decided whether or not they would bp permitted the uso of an "advocate" at the hearing. It was staled that tlio appellants considered their powers inadequate to represent their cases psnp-etly at tho hearing. It has not been the practice hitherto to allow counsel to rspresant either patty at the hcarinjr of appMils hrfore judges appointed by the president of the Racing Conference. The present judges aro of tho opinion that the practice has been a proper and salutary i ne, and neither party h«3 suffered by its adoption in having his "case adequately presented and carefully considered by tho judges. They •ire 1 oHio depart from this well rccogniscd procedure, and do eo upon the distinct undoiT,landing- thai it shall not form a preco•knt for tho procedure of hearing future appeals. They have decided in these cases to permit tlio appellants to be represented c-y counsel on the hearing of these appeals for tho solo reason that, in tho abnormal conditions which havo arisen, they desire to make impossible any suggestion tha.t tho appellants were unable to adequately present their cases before them. The judges wish to make it clear that the counsel permitted to appear must be a barrister or solicitor of the Supremo Court, representing only the appellants-, and (lie hearing will be confined strictly to tho question whether the appellants or any of them havo boon rightly adjudged to have committed tho offences against the Rules of Racing tltf sub.v>ct of the above decisions, and havo been rightly punished for such offences. It follows, from tho permission given 1o tho appellants' to be represented by counsel, that the respondents will have a similar right. The hearing of the appeals will therefore bo adjourned to Wednesday, July 21st, at 10.30 a.m., at the Accountants' Chambers, Johnston street-, Wellington.
