NEW PLYMOUTH, M% 14. The criminal sessions of the Supremo Court were continued to-dav before the Chief Justice, Sir Robert Stout. Iloho ( Billy ') te Whiti was found guilty of using indecent language and making an aggravated assault at Rahotu on Constable and common assault on Constable O'Neill. Accused was acquitted on a charge of committing a grossly indecent act.
Mr Fitzherbert gave notice of intention to movo for a new trial on the ground that the Judge, in liis charge to the Grand Jury, had mnrj guilt of the prisoner, and in summing up had presented to tho jury l.ic cuavfor the Crown only. _ The Judgc said the motion was a ridiculous one.
The trial of Te Whiti and 17 other Natives on charges of taking nart in a riot and assaulting Constable O'Neill at Rahotu on March 28fcJj are proceeding.
