(PKF.SS ASSOCIATION TELEGRAM.) WELLINGTON, October"2B. In the appeal case, Education Board of Auckland v. the Public Trustee, affecting the claim to a block of land in Auckland, said to be worth J___<_,ooo, the Appeal Court (Mr Justice Edward. diseenting) gave judgment that the Board had no claim, but that th© Public Trustee held the lands upon trusts defined by law for educational purposes in tho province of Auckland. The Court considered that the trusts could not' bo properly carried out without assistance, either from the Legislature or under a scheme approved by the Court. Costs ou the highest scale were allowed both the Board and the Public Trustee, to be paid out of trust funds.
The Full Court delivered judgment in tlie case of Gualter, Dykes aud Co. v. Begg. The defence took up tho ground that appellants, who are sharebrokers, had not sent duly stamped contract notes. Tho Court held that this was illegal, and the defence was good. Appellants could not recover, even whore they had re-sold the shares at client's request, and tho latter had obtained all the benefit ho could under the contract. Costs were fixed at £20.
