CONDEMNED POULTRY.

Dr. Finch, District Health Officer, j applied to Mr H. W. Bishop, S.M., j at Lyttelton, yesterday, for an \ order tor the destruction of 113 cases j of poultry, 6tored in the Lytteltori | Hirbour Board's cool etoro at Lyttel- j ton, on the ground that the poultry j was unlit for human consumption. j .Mr right appeared for Dr. Finch, j Mr Harper on behalf of tho Lvttolton j Harbour Board, and Mr Xoavo ior i Messrs Wood Bros., Ltd., owners of tho poultry, who were joined with tho j Lyttelton 'Harbour Board as defendants. Evidence was given to the effect that the poultry, which was valued at about £200, was stored in tho HerIwur Board's cool store about eighteen months ago. A large number of the coses were inspected early this month, and about thirty cases were found to ho putrid, and other cases boing in all stages from medium to fairly pood in appearance. According to tho Government grader, the poultry had been allowed to thaw out and had then been frozen again. Mr Bishop said that, on the «vi« denco, ho was not prepared to Bay that he would be justified in making an order for tho destruction of the -whole of the poultry. Ho suggested that counsel tshould agreo either to the destruction of the -whole, or that the poultry should be thawed out, and thoso 'which might havo conic value preserved. After discussion, counsel agreed to an order for tho destruction of the poultry, with the oicoption of the cix cases required by tho Harbour Board for purposes of evidence. His Worship said he would make an order for the destruction of the whole of the poultry, Jeas cix cases to be retained for the purpose of evidenoe between the parties in tho action. He did not think v penalty was called for, and therefore would make no order as to the expenses of destruction.
