John Schisch'ka, a well-known Auckland wholesale merchant, was charged to-day at tho Police Court, at tho instance of tho Stock Department, with being tho vendor of upwards of o c\vt. of fc-ntifiser, for which ho had failed to deliver to the purchase!- an invoice containing true particulars of the fertiliser, as required by the Fertilisers Act, lu*o4; also, with having caused seventeen packages marked with a registered brand -to be filled with fertiliser at vaTianco with tho registered fertilisers of tuo brand, without effectually effacing the brand of the Gisborne Sheep Farmers' Frozen Meat Company. Defendant was further charged with havuig fraudulently imitated tho Gisborne Sheep Farmers' Freezing Company's brand. Defendant's solicitor pleaded guilty to tho charges of failing to render an invoice and filling packages with fertiliser at variance with the brand, but not guilty to tho indictable charge of having fraudulently imitated the iSheep Farmers' Freezing Company's trad© mark. Tho prosecuting solicitor stated he could not proceed with tho indictable charge that day. His Worship granted an adjournment till Saturday week, and reserved his decision upon the summary charges.
