MAGISTRATE'S COURT.

CIVIL LIST. .Mr R. Beetham, S.M., gave judgment by default in the following cases yesterday : —George McClatchoe and Co. (Mr Francis) v William L. Smith, claim £1 10b; e-vme v George Collier; claim £1 10s. William Milne (Mr Leatham) sued C. E. Fisher for £13, alleged to be due as wages at £1 per week. Evidence was given that plaintiff had agreed to accept 10a per week and his board. The sum of M 10s, which the plaintiff alleged was given to him aa his half share of a totali-sator dividend, and which defendant said he had paid to Milne as wages, was held by the Magistrate to have been a half-hare in, a totalisator ticket. Judgment waa given for £5 (wages at the rate of 10s per week), and costs, 23s 6d. A case in which M. O'Brien (Mr Crestwell) claimed £1 10s 4d from C. W. Fisher (Mr WMdowson) occupied some time. Fisher, it appears, had been engaged by O'Brien to collect certain bad dtebta, one of which was subsequently aettlect*by-a composition arranged by Mr J. A. Frostiok,, with which Fisher had nothing to do. Fisher, however, in submitting his statement, claimed coin——Bsion on this debt, and deducted at the rate of 20 per cent., as agreed, claiming to have been instrumental in the recovery of the money received by plaintiff, because he had gone to the debtor's house several times to endeavour to collect. The Bench held that Fisher j was not in any way instrumental in collecting the debt, and that, therefore, he had no claim to the commission on it. Judgment was given for O'Brien for the £1 10b 4d in dispute. j
