Mr Brabant, in giving judgment, said it appeared defendant got 5s from each, of the others, -and, including his own ss, had purchased a ticket, and had given it to one of the partners to go and get a dividend. . In order to make the defendant ' responsible it certainly appeared to his Worship that the person who received the dividend should be the,agent of' the plain- , tiff,' but this he thought had not been established. . It appeared certain that this 1 partner.(the stranger) kept the money him- ' self—one might say stole" the, money. He ; did not see that he could make defendant , responsible for the dividend. He never . had the £1 12s 9d, the sum sued for, and i- plaintiff was accordingly nonsuited.
