AN INVESTOR WHO LOST HIS DIVIDEND.

Ah exemplification of the process of backing a winner and losing by it was given in the Magistrate's Court, when Ruben Scarborough sued David Parker for £1 12s 9d\ Plaintiff said that' while at the races on June. sth, at Ellerelie, he went into partnership with some others in a totalisator ticket. He took a-fourth share (ss), handing the money over to the defendant. The horse he backed was St. Ursula, and she- won. James Wheeler," gardener, deposed that he gave defendant 5s for the purchase of the totalisator ticket, and received as his share of. the dividend £1 12s 9d. Defendant gave the ticket to a man Who was a stranger to' witness to present at the machine, and this man paid witness. Plaintiff was not . present. . Mr Brabant, in giving judgment, said it appeared defendant got 5s from each, of the others, -and, including his own ss, had purchased a ticket, and had given it to one of the partners to go and get a dividend. . In order to make the defendant ' responsible it certainly appeared to his Worship that the person who received the dividend should be the,agent of' the plain- , tiff,' but this he thought had not been established. . It appeared certain that this 1 partner.(the stranger) kept the money him- ' self—one might say stole" the, money. He ; did not see that he could make defendant , responsible for the dividend. He never . had the £1 12s 9d, the sum sued for, and i- plaintiff was accordingly nonsuited.
