Tuesday, February 7. (Before his Honour Mr' Justice Denni-tcn.* His Honour sat in Chamber-; at lC.iv a.m. MOTION* OF APPEAL. Mr Stringer applied for leave to appeal from his Honour's judgment in the case of the Le Bon's Bay Road Board v Oldridge. Mr Fisher appeared for the Road Board. Sir Stringer poiuted out that, although the amount involved was small, appeals had been granted for smaller amounts. His Honour refused to grant the application, en the grounds that the amount involved was ridiculously £jnall; that there was no likelihood of a second injury to the appellant; that there had been too much delay in bringing the appeal, and that (although he would like to tee the matter determined) there was no doubt as to the decision. sr-u_ONS for further discovery. Mr Fisher appeared in support of an application for a summons for further discovery in the caso of Gavin Gibson and Co. v Tyree. Mr Beswick appeared for Alfred Tyree. After hearing lengthy argument, his Honour said that unless the applicants could show absolutely the existence of documents affecting the case, they had no right to further discoveries. He refused to grantthe summons, characterising the proceedings as premature. He reserved the question of costs. BRETT y cos. Mr Beswick appeared in support of a summons for argument of a law point in the above case. Mr Bruges appeared for the plaintiff. His Honour said he required to be shown that the point of law was arguable, and adjourned the application till Friday. PROBATES. Probates were granted in the cases of Jane Duncan, deceased (Mr Slater}, and Thos. Bruce, deceased (Mr Slater.)
