Friday, February 3. (Before Jas. Forrester and Jas. Gapes, Esqs., J.P. _.) Drunk and Disordehly.—Ernest George Kelly was charged with being drunk and disorderly and assault. Mr Donnelly at)Seared for the accused, who admitted the j runkenuess, but denied the assault. Constable McKenzie stated that at 7.30 p.m. on Thursday, he, saw tho uccused trying to force -his way into the Al Hotel. /The licensee, who was standing at the door, prevented him, and he struck the licensee in the face. The licensee thereupon pushed him and he fell. He then again tried to get into the hotel, and witness arrested him. Mr Donnelly said the assault was only a trifling one, and the licensee had promptly punished him. He was fined 5s for being drunk and 10s for the assault, with the usual alternative. Charge Dismissed.—Harry Brown was < charged with using obscene language about midnight, in B/irbadoes street. Mi> Donnelly appeared for him. Constable Preniske deposed to -tearing the language and arresting the uccused, who .was witn three other young men. Witness admitted that he had not told the accused why he arrested him, neither at the time of arrest nor at the lock-up. There was no. corroborating evidence. The .accused and two witnesses, who were iii company with him, swore that "the words had. been used by a fourth person who got away. The chairman said it was possible the constable had made a mistake, | and the case would be dismissed.'
