Alluding to the Masterton murder case he said the question of the sanity of the accused, Andrew J. Somerville,.might be raised, but that was a matter for the consideration of the Judgfi and not for the jury to consider. As lo the case in which Andrew Kennedy and Joseph Jewett were charged with causing the death of a woman in a Chiua.nau's house, in Haiuing street, by throwiug a lamp at her, his Honour said the evidence pointed to one rather than both of the accused; but, as it was of a curious character, the better course for tiie jury was to find a Bill ugaiust both men if they were satisfied there was a case to answer. The case against Uavey charged with falsely applying a trade mark to a machine covering was a remarkable one in that tha Legislature had placed the onus upon the defendant to prove that he had authority to use the trade mark. All the prosecution had to prove was that the trade mark had been, applied. He thought it was remarkable for the Legislature to assume that it had been falsely applied and place the onus on the accused. _Yank Philpott, alias Woods, pleaded amity to several charges of forging and uttering cheques, and was remauded for sentence. George.Draper pleaded guilty to stealing a tin of caustic soda from Mills and Co.'s warehouse. He was remanded pending the report of the probation officer. True bills were found in both the Masterton and the Haining street cases.
