AN IMPORTANT OPINION.
(PRESS ASSOCIATION TELEGRAM.) AUCKLAND, November 27. The City Council and various local Borough Councils recently decided to impose on additional 10 per cent, on all rates overdue six months not paid by a certain date in D_cen_ber. It now appears that this additional charge is illegal. Messrs Devore and Cooper, solicitors, wrote as follows to the Devonport Borough Council: —" We have considered the question, submitted by the Mayor, whether rates which remain unpaid after six months from the date on which the same first become recoverable bear additional the charge of 10 per cent, specified in section 60. That question applies to the rate already made, for as to rates to be made there is no doubt liability attaches. The Act provides that any rates made prior to the commencement of the Act of 1894, which came into operation on the 9th October, may, if necessary, be sued for and recovered under the repealed Act as if the Act of 1894 had not been passed. Iu our opipion the 10 per cent, does not apply to the x rates already made in arrears." The solicitors' opinion was received aud ordered to be published.
