Application.—Mr H. N. Nalifer applied for a rehearing of the case Paton v Hunt, damages by fire, decided' in the Resident Magistrate's Court, Akaroa, oh the ground of short service of the summons, and insufficient time allowed to obtain evidence. The facts were that the fire happened four and a half years ago, and defendant received no notice of claim till the summons was served upon him on Monday for hearing on the next Thursday. The Resident Magistrate observed the facts were as stated, but, as a matter of practice, it would be moat inconvenient to consider an application in reference to an Akaroa case in this Court, or in the absence of all the parties. For the reasons stated by Mr Nalder, he offered defendant an adjournment, which was not accepted, and all he could do was to stay execution, if it had not been taken out, until hecouid hear the application for a rehearing at Akaroa. No promise could be given that even then the application as applied for would be granted.
