MAGISTERIAL.

CHRISTCHURCH. Monday, March 25. [Before C. Whitefoord, Esq.,RM.l Failing to Pmvide.—Daniel Smith was charged on warrant with failing to obey an order of the Court to pay 10s per week towards the support of his three childrep, being £32 in arrears. The children were in the charge of an elderly woman, and they were partially supported by their uncle and by the Charitable Aid Board. The defendant had provided nothing for their maintenance since October, 1887, but had kept out of the way. In 1884 the defendant had received a sentence of six months' imprisonment on the same grounds. His Worship now sentenced him to gaol for a similar term with hard labor.—Alexander Smith was ordered to pay 7s 6d towards the support of his wife.

Civil Cases.—St. Albans Borough Council v Malcolm, claim £3 4s 6d, for rates. Plaintiffs did not appear, and the defendant produced a receipted account. The case was struck out, with costs, and 10s expenses were allowed the defendant. Judgment was given in McConnell and Douglas v Hutchinson, claim £19 18s 2d. This was a case in which the defendant since incurring the debt had been made bankrupt, and had in due course received his discharge. Plaintiffs, however, claimed to recover because the debt was not included in the "three days' statement," aud notice of the insolvency had not been sent to the plaintiffs. They contended that by this omission the proceedings in bankruptcy had been rendered null and void so far as this claim was concerned, leaving the defendant sueable as before by them. His Worship said that by giving a judgment for the plaintiffs he would be seeking to set aside the proceedings at the Superior Court. Judgment was, therefore, for the defendant, with costs, £1. Plaintiffs gave notice of appeal. Judgments went for plaintiffs by default with costs in Hargreaves v Hart, £10; Anthony, Sellars and Co. v Gaze, £1 8s; Twentyman v Hobday, £40; and Anderson v Baker, £27 14s lOd. New Zealand Farmers' Cooperative Association v Shaw was adjourned till March 26th.
