ILLEGAL BY-LAWS.

AUCKLAND, September 20.
The Kawakawa County Council sued a travelling representative of the Singer Sewing Machine Company at a sitting of of the Kawakawa KM. Court a few days ago for a breach of by law. Some time ago, in response to a petition from local tradesmen, the Council passed a resolution preventing the practice by travellers of holding the usual forced sales of large stocks in the district. The Council decided to include in the by-law all travelling agents who offered goods for sale, and thus the present action was taken. Mr Bishop, BJtf., held for the defendant, and ruled that the by-laws upon which the case was grounded were -ultra vires, as he considered that the County Council had no power to go behind the ordinary accepted meaning of the words " pedlar and hawker."
