[Before C. "Whitefoord, Esq., 8.M., and W. Buss, Esq.] Civil Cases.— J. Hurse vH. Mehrtens, £3 Is, for alleged illegal impounding of forty-three ewes. Mr 'Helmore for plaintiff, Mr Spackihan for defendant. In thie case plaintiff had given defendant an assignment of certain land, including a sheepyard, but subsequently the plaintiff now maintained he rented the sheepyard at a yearly rent of a pound a year. Kent had been paid for the first year, and when plaintiff went to England he told defendant the rents would be paid by his agent. A fortnight ago plaintiff placed the ewes in the yard. Next morning they were impounded, and the claim was for pound fees and damage by driving. Counsel for defence raised the question of jurisdiction, and contended that carol evidence could not be accepted of a written contract. For plaintiff it was submitted that the matter was a yearly tenancy subsequent to the assignment. At this stage the parties agreed to an adjournment, which was granted for a week. Mandeville and Kangiora ..Road Board v W. Mardon, £2. Is 8d ratps; adjourned from last week. Defendant's son, aged twelve, stated he took some money—over a pound —to the ex-Clerk of the Board, which he gave to a woman who came to the door. J. B. Sheath, late Collector of the Board, denied that any money on account of Mardon's rates had been paid to him. Mr Mardon stated he had never paid Mr Sheath any other monies. Mr Sheath here produced documents showing that defendant had paid him an amount for rent. This Mr Mardon now admitted was correct. The Bench said although there was some doubt about it; the evidence of the boy was clear about the payment of one year's rate. Judgment for plaintiff £10sl0d and costs. Tombs and Lilly v G. Prohibition Order. —An order was made against publicans and others supplying J. B. Judson for twelve months. Adoption of a Chim>.—An order was made allowing D. Boyce, Sef ton, to adopt a child eleven weeks old.
