* SITTINGS IN BANCO.
Saturday, November 5. [Before his Honor Mr Justice Ward,] His Honor held a special sitting in banco at 10.30 a.m. HEYWOOD AND OTHERS V LATTEB AKB OTHERS. In this case the plaintiffs who are the executors of the will of the late T. M. Hassall (deceased), sought to recover from the defendants, the executois to the will of R. H. Rhodes (deceased), the sum of &WCO. The facts shortly stated were that Mr Hassall had been concerned in some partnership matters with Mr R. H. Rhodes, and had 'become indebted therein. The Trustees of Mr Rhodes' will became possessed of certain moneys belonging to HassalFs estate, and claimed that they were entitled to retain it as a set-off against the partnership accounts. The plaiatiffs demurred to this, and brought the present action. Mr Martin for plaintiff, Mr G. Harper for defendant. After argument, his Honor gave judgment for the amount claimed, with costs.
