The accused wai then further charged with the larceny of a boiler. Edwin Mossman, sworn, said he purchased a section of land and house in .Burnett street. There was a copper boiler fixed outside the house in brickwork. He wrote to the accused not to remove it, as it was particularly pointed out to him as one of the articles he had purchased with the section at the sale. This waa on the 3rd January, and he bought the premises about three weeks previous to that date. The boiler was on the premises the day previous to the 3rd, and was then fixed in the brickwork. The boiler outside the Court being a galramsed iron one, and the information being for the larceny of a copper boiler, the case was dismissed. - Mr Ireland said the case was a trumped up one, and bad been got up through some spite. His Worship said the caße clearly ought to have been a civil one He would dismiss all the charges, and allow costs for three witnesses, &c, amounting to £7 6s. Sergeant Felton asked his Worship to allow the police to hold over the articles outside the Court, sa the proof of ownership had not been given by any one excepting the accused, who was lately a bankrupt.
