PROVINCIAL COUNCIL REPRESENTATION ORDINANCE, 1869.

The following Bill has been drafted, and will, we believe, be introduced by the Government during the next session of the Provincial Council :— A Bill for an Ordinance entituled " The Provincial Council Representation Ordinance, 1869." Whereas by an Act of the Imperial Parliament passed in the fifteenth and sixteenth years of the reign of Her Majesty Queen Victoria entituled " An Act to Grant a Representative Constitution to the Colony of New Zealand it was enacted that it should be lawful for the Governor by proclamation to constitute within each of the provinces by the eaid Act established convenient electoral districts for the election of members for the Provincial Council and of the Superintendent and to appoint and declare the number of members to be elected for each such district for the Provincial Council and to make provisions for the registration and revision of lists .of all persons qualified to vote at the elections to be holden within such districts. And whereas the then Governor of New Zealand did accordingly by proclamation bearing date the fifth day of March one thousand eight hundred and fifty-three constitute certain districts for the election of the Superintendent and members of the Provincial Council of the Province of Canterbury and did appoint and declare the number of members to bo elected' to eerve in the Provincial Council for each of the said several districts and did further make certain provisions for the registration and revision of the lists of persons qualified to vote as aforesaid And where-

as by an Ordinance of the Superintendent and Provincial Council of the said province entituled " The Provincial Council Extension Ordinance Session 111.. No. 1 " certain provisions of the said proclamation were repealed and certain other provisions enacted in lieu thereof And whereas by an Ordinance of the Superintendent and Provincial Council entituled "The Provincial Council Extension Ordinance Session VIII. No. 8 " the said last recited Ordinance was repealed nnd certain other provisions were enacted in lieu thereof And whereas by an Ordinance of the Superintendent and Provincial Council entituled "The Provincial Council Extension Ordinance Session XVII. No. 4 " the above recited Ordinances were repealed and certain other provisions were enacted in lieu thereof And whereas by an Ordinance of the Superintendent and Provincial Council entituled " The Provincial Council Extension Ordinance 1866" the above recited Ordinances were repealed and certain other provisions wero enacted in lieu thereof And whereas it is expedient that the said recited Ordinances should be repealed and that the provisions of the said proclamation should be further amended : Be it therefore enaoted by the Superintendent of Canterbury with the advice and consent of the Provincial Council thereof as follows : 1. The eaid recited Ordinances of the Superintendent and Provincial Council are hereby repealed. 2. The provisions made in the said Proclamation by the Governor of New Zealand under the authority of the said recited Act of j the Imperial Parliament in respect to the number and extent of the said districts the number of members of the Provincial Council to be eleoted for each district so far as the said provisions are repugnant to or interfere with the operation of this Ordinance shall be and they are hereby declared to be void and of no effect. 3. The Province of Canterbury for the Election of the Superintendent and of the members of the Provincial Council thereof shall be divided into thirteen districts to be named as follows : 1. The Cheviot District 2. The Ashley District 3. The Kaiapoi Distriot 4. The Avon District 5. The Heathcote District 6. The City of Christchurch District 7. The Town of Lyttelton Distriot 8. The Mount Herbert District 9. The Akaroa District 10. The Selwyn District 11. The Coleridge District 12. The Timaru District 13. The Gladstone District And the boundaries of the said districts shall be those particularly described in the schedule hereunto annexed. 4. The Provincial Council shall consist of twenty-five members, and the number of members to be elected for each of the several districts shall be as follows :— 1 For the Cheviot District Member 2 For the Ashley District Member 3 For the Kaiapoi District Member 4 For the Avon District Member 5 For the Heathcote Dietriet Member 6 For the City of Christchuroh District Member 7 For the Town of Lyttelton District Member 8 For the Mount Herbert District Member 9 For the Akaroa District Member 10 For the Selwyn District Member 11 For the Coleridge District Member 12 For the Timaru District Member 13 For the Gladstone District; Member 5. Immediately after this Ordinance shall have received the assent of the Governor on behalf of Her Majesty the Registration Officer appointed by the Governor for the Province of Canterbury shall from the Electoral Rolls for the House of Representatives for Electoral Districts situated or partly situated within the said province form Electoral Rolls for the election of the members of the Provincial Council of such province. ! 6. In forming such Rolls the name of every elector on any Roll for the House of Representatives in respect of any tenement or hereditament situated within any Electoral District constituted by this Ordinance shall be placed on the Electoral Roll o? Rolls of the Electoral District or Districts constituted by this Ordinance in which the lands or tenements in respect whereof he is so registered are situated. 7. The Electoral Rolls ao formed for each district shall be the Electoral Roll to be used for such District until a revised or new Electoral Roll far the same shall be in force according to law. 8. This Ordinance shall come into operation on the day of the next dissolution of the Provincial Council. 9. This Ordinance shall be entituled and may be cited as " The Provincial Council Representation Ordinance 1869." A Schedule ie appended to the Bill defining the boundaries of the various electoral districts.
