New Advertisements. [ADVEfcTISKMBirr.] TO THE BDITOB OF THE PRESS. SIR, —Under the heading of " Supreme Court—ln Chambers," in your Saturday's issue, and in the matter of the " Percival Trust," and Mr Joynt applying, on behalf of the Trustee, for directions regarding the same, there appears a false statement, which I must ask to be allowed to contradict. It is this : Mr Joynt stated that at the time of my final examination, " the assets were realised upon as far as they could be." Such is in no way correct, for the first instalment of my assets was not sold until my final order had been made some time, and the second and last portion until some months after that, viz., August 25, 1866. So much for Mr Joynt's accuracy in stating vrhat ho did. I can also prove that at the time of my final order, there was every reason to suppose that there would have been far more than suffioient from my assets, when realised, to pay every legal demand, and that, had only ordinary care and judgment been exercised, there would have been a balance in hand for a dividend. I also believe, and am certain, as far as I can be of anything, that there was no order made for the payment of costs out of the estate. The whole matter is an enigma to mc, and my object in making it public is to have the matter sifted. For the honor of the Canterbury Bar —for the houor of the Court— and for the interests of myself and creditors, there ehould be a searching investigation, and particularly as all the parties are to the fore ; Mr Joynt is here, I am here, and the late trustee could be had in a few hours from WelUngtou. I can also prove, that out of the things ruled by the Judge's order to be given up to my creditors, some portions went wrongly co to the bill of sale, thus making my estate so much the worse. I noticed this at the time to the trustee, but as my creditors were careless, bo it was, and I suppose must be. Where then was the attorney for the Trust f or rather, of what use was he ? With regard to Mr Joynt's idea of " contempt." I can only say it is most unique and harmless, and to cite as a casein point the "contempt" referred to in re Buss and Hepworth is, if possible, more ridiculous still; there can bo no affinity between the two. Our trustees simply say,— Gentlemen creditors, —Do that which ie most conducive to your own interest, by selling the life-interest or otherwise, but allow us, as men knowing our business and duties, to warn you of the consequences that in our opinion must bo ensue; So much for the "contempt" alluded to. I soy to my croditors—Gentlemen, I admit your right to sell my lifeinterest, as an asset returned by mc, if you prefer that to trusting to mc and the sooner you do so the better I ehall like it. I made the mistake and have warned you of it. I huve paid so much out of bo much, and would have paid the rest. But while fully admitting your right to sell, I deny that Mr Joynt hue any right to do bo, and that for the following reasons: —In the first place there can be no entry, vouoher, or anything found amongst the papers given up by the late trustee, that | can authorize j»«cb,.navment heiit's made; inthej next, the probability is, already paid in law charges, his last bill could not be made good ; further, Mr Joynt was specially retained by mc, and for such work has been paid £63 10s 4d, and how could he engaged for the trust?
