BREACH OF PETROL PERMIT
MAGISTRATE DISMISSES INFORMATION MOUNT GARAGE PROPRIETOR ' CHARGED Charged before Mr E. L. Walton S.M., at the monthly sitting of the Tauranga Magistrate’s Court yester•lay, wu.n disposing of motor spirit to another person except in accordance with the terms of sale or disposition granted by the Oil Fuel Controller and otherwise than for removal in containers not exceeding one quart, Gladwym Corry i-vJey, a garage proprietor, of Mount Maunganui,. pleaded not guilty through Mr J. K. B. Lusk. Alter hearing the evidence the Magistrate dismissed the information. Giving evidence, Inspector R. J. Opie told the Court that on February 2 he checked the petrol record book kept by defendant. The records showed that a total of 1797 gallons had passed through the pump for the month of January and defendant had a permit which allowed him to dispose of 1710 gallons. tie had exceeded his quota by 87 gallons. Counsel for the defence submitted that there was. no "proof of what took place on January 31.
