NO PRIVY COUNCIL APPEAL
THE ELECTRICITY DISPUTE Decision Of Board Further Litigation To Be Avoided The dispute between the Tauranga Electric Power Board and the Tauranga Borough Council was considered in committee by the Power Board at its monthly meeting on Thursday and the following statement was handed to the Bay of Plenty Times by the secretary to the board ,(Mr J. R. Chambers) yesterday: — Bulk Supply Dispute The following resolution put to the board was lost: “For the purpose of protecting the position in case the board shall find it necessary to appeal to the Privy Council, the solicitors should be instructed to apply for conditional leave, the question of whether an appeal shall be made against the court of Appeal decision to remain open for subsequent decision by the board.” The following resolution was carried unaniiwonsly: “That it be the policy of the board to do everything in its power to finalise this dispute and above all to avoid further litigation.”
