POLICE COURT

MAN INTOXICATED IN CHARGE OF CAR. At the Police Court this morning, before Messrs L. R. Wilkinson and E. L. Broad, J.P.’s, Henry Nicholas was convicted and discharged on the charge of being found drunk and of assaulting Doris M. Nicholas. For using obscene language in a public place accused was fined £ 2 and prohibited for twelve months: also, he was ordered to apply to a Magistrate for a prohibition order for himself for life.

Harvey Nicholas, was charged with being intoxicated while in charge of a car on a public place. Sergeant Mclntyre said accused arrived in town on Saturday from his farm and had been drinking. He was warned by Constable McKenzie not to get into the car. In spite of the Constable’s advice he did so and was arrested.

Mr Auld, for defendant, said there had been friction between accused and his wife. Accused approached the car more to annoy his wife and had arranged for someone to drive it. He had not been in trouble for eight years. He (Mr Auld) hoped the bench would not take the car driver’s license away from accused, as he must have a car to enable him to work his two farms. One farm was at Whakamarama and the other at Omanawa, about 15 miles apart and twelve miles from town.

Sergeant Mclntyre said that accused was fined £lO for a similar offence in 1927. The Bench said drink appeared to be the cause of the trouble. Taking into consideration counsel’s plea in regard to the necessity for accused to have a car for his work he would be fined £lO and £1 Is doctor’s fee, and his driver’s license would be endorsed, the endorsement to continue for two years. He was advised and consented to take out a prohibition order against himself.
