Patrick Mannix, being duly sworn, deposed ; I have asked Mr Bennett for tho money on several occasions, and ho has always refused to pay. I billed him with it at tho latter end of last month. He came clown on the 2Gtb into Mr Holler’s shop, and he asked mo out, Wo went to tho Taurauga,’ Hotel, when he produced the bill 1 had given him and asked mo to sign it* I signed the bill thinking that I was going to get the money, but he snatched the bill out of my hand, threw down £3 Is Gd on tho table and ran away. I asked him foi the money previous to this, and ho said ht would not pay it to me ; that ho had the law in his own hands, and could do as ho liked. By defendant: You did not send £5 home to me by my youth on February IG, 1874 I am not aware that there was a balance oi £3 on a boardingdionso account I owed for. John Mannii, being duly sworn, deposed I am a witness to the agreement made bolweer the plaintiff and defendant for £B. At first defendant said he would not give plaintiff that sum, but afterwards ho said ho would give it him provided lie would box in the chimncj breast, Mr Bennett told plaintiff that he had tho law'm his own hands, and would not pay. By tho Court: lam plaintiff’s brother, James Bennett, being duly sworn, deposed ; Ido not owe this money. I produce plaintiff* receipt for full amount. By tho plaintiff: You gave me that receipt yourself. I paid you in full that account. I put £3 Is Gd on the table in tho Tau range Hotel, and walked away. You then came after mo.
