In the Supreme Court at "Wellington yesterday, Mr Justice Cooper gave judgment in the case Andrew Ja-clv v. Palmerston Borough Council, rhe question of general interest, involved was Avhether or not a local body had the right to authorise one iind only one type of appliance —a rentilator in this case —for .any particular A\ork, and exclude all others. The Judge said the. Council must bo presumed to know what was best in the interests':of the borougli and must be credited Avith having exercised its. discretion \vitli due regard to such interests. The Court could not usurp the- functions- of the Council in a matter within the discretion of that body. Judgment went for 'defendants with costs.
