In the Hotel Commonwealth case the Chief Justice axpressed the opinion that what had been done amounted to an evasion of the. law,, but was not met by the express words of the statute, also that there must be a vacant license at the time of hearing and thai the requirements as to accommodation must be complied with. This was not done and the license should be quashed. Thejother judges took a different view, and held that the circumstances did not amount to ' removal within the meaning of the Aot, that it wes sufficient if the license , was actually granted and if the premises are completed by the time the license is issued. The jury found that the death of Win. Sneyd was caused by a signal rocket fired by Captain McGilvray, and also expressed the opinion that the Couueil and police showed neglejt in not enforcing their powers. McGiltray was charged with manslaughter, and remanded on bail in two sureties of £100.
