A WIDOW'S CLAIM
Judgment has been given by Mr. Justice Ongley in the Compensation Court in a claim by Mrs. Alice Jane Morey (Mr. Finlay) against, Residential Construction Ltd.. Auckland (Mr. West), for compensation arising out of the death of her husband. Donald Charles Morey, from heart failure claimed to have arisen whilQ at his work for defendant in April, 1942. The preliminary question argued before the Court was barred by delay in bringing the action, which was not commenced till August, 1945.
His Honor said plaintiff relied on the delay being caused by "mistake" or "other reasonable cause," and after considering, the authorities came Ito the conclusion that the delay was not caused by a mistake of fact, but by a mistake of law, and the claim was consequently barred. Judgment was for defendant.
