SELLER OF TICKETS PINED

It was probable that, if application had been made to the Minister of Internal Affairs for a permit to hold a lottery, permission would have been granted, said Mr. J. H. Luxford, S.M., in imposing fines totalling £4 on John Robert Sutcliffe, a confectioner (Mr. J. J. Sullivan), who pleaded guilty to two charges of selling tickets in a lottery.

Detective Sergeant Aplin said that on a visit being paid to the defendant's shop at 325, Great North Road, it was found that he had been selling 1/ tickets at the rate of 50 a week during the last six months. He received a commission of 2/ in the pound, and the profits went to the Auckland Waterside Workers' Silver Band.

Counsel said that Sutcliffe was a member of the band executive. It had been decided to hold the lottery in order to assist the paying-ofT of £1000 incurred in the purchase of new instruments for the boys' section of the band.
