AWARD NOT GRANTED
The Court of Arbitration has] given its decision on the application made by the Auckland Fruit and Vegetable Traders' Union of Employers to make into an award an agreement entered into with the employees' union. Objection was lodged to this application by the Chinese Fruit and Vegetable Traders' Association.
In its decision the Court points; out that the industrial dispute in; question had not been created in! accordance with the provisions of section 108 of the Industrial Conciliation and Arbitration Act. There were other irregular/lies in connection with the proceedings, added Mr.! Justice Tyndall. in deciding that the Court should decline to grant the application to incorporate the terms of the settlement (as put forward) in an award.
