PROVISIONS AGAIN STRESSED.

At the request of a correspondent, t'lie "Star" publishes again the emergency regulation dealing with the re-employ-ment of any man who enlists in the Dominion's forces for service either at home or abroad. The regulation was ga/.ettcd on October 13. Inasmuch as some assurance for their employment when they return is given men who enlist, the correspondent considers thai another reference to the regulation would give an impetus to recruiting. The most important section of the regulation is that stating:— "It shall lje the duty of nny employer, hy whom or by the predecessor of whom in the relation of employer, a person accepted for service in His Majesty's Forces, whether in New Zealand or overseas, was employed when he was so •ccepted for service, to reinstate him in his employment at the termination of service or during any period of leave from that service without pay, in an occupation and tinder conditions not less favourable to him than those which would have been applicable to him had he not been so accepted, including benefit of conditions providing for increments in remuneration, such benefits to attach so as to entitle him to remuneration at the time of reinstatement at the rate which lie would t'hen have received hud his employment been continuous up to that time.' Penalties for Breach. The regulations state that an employer who fails to comply with the provisions of the al>ove-mentioned clause commits an offence and, in addition to any other penalty imposed, may !><• ordered to pay the person whom he has fftiled to reinstate ia sum not exceeding an amount equal to 12 weeks' remuneration or remuneration for the period o*| leave. i

The regulations also set out provisions which may be used by employers in justifying tl'eir non-reinstatement of employees. These include failure by an employee to apply for reinstatement within six months of the termination of overseas service or during any period of leave without pay, and also if ail employee, having been offered reinstatement, foils without reasonable excuse to present himself for employment at the time and place specified, or by reason of a change of circumstances (other than engagement of some other person to replace, him). Employers will not be nJlowed to terminate the employment of employees for the purpose of evading the obligations imposed under these regulations or in expectancy that the employee might be accepted for service in His Majesty's The regulations also make provision for employees where a contract of service is concerned and are 1 subject to suspension of the Apprenticeship Emergency Regulations, 1939.
