SECOND TIME.

INTOXICATED IN CAR. SALESMAN IS CAUGHT. SENTENCE OF TEN DATS. For his second offence for being in a state of intoxication while in charge of a motor car, in Broadway, on Saturday afternoon, a motor car salesman, Stephen Mount Robinson, aged 52, was sent to prison by Mr. \V. R. McKean, S.M., in the Police Court to-dav.

Robinson, who pleaded guiitv, was represented by Mr. W. \Y. Meek.

Sub-Inspector Pender said that shortly after •"> p.m. on Saturday, Traffic Officer Shepherd was a passenger on a tram going up Parnell Rise when his attention was drawn to accused, who appeared to l>e intoxicated and was about to enter a motor car. The traffic officer left the tram and followed in a motor car. Accused's car was steering an erratic course and when it stopj>ed at the corner of Mortimer Road and Broadway. Robinson was found to be intoxicated. He was examined by a doctor, who certified that accused was intoxicated and unfit to be in charge of a car. He had a previous conviction for a similar offence in 1930.

On behalf of the accused. Mr. Meek said Robinson was married and had two children. A ear salesman by occupation. he had driven cars for 32 years. On Saturday he was working until 4 o'clock, when he had three or four drinks.

"Robinson suffers from war injuries and nerves," added counsel. "The punishment of losing his license, in view of the fact that he is a car salesman and will lose his job, is greater io Robinson than to the ordinary man. He is willing to take out a prohibition order. I would ask that he be fined and not sent to prison." Mr. MeKean: He was dealt with leniently on the previous occasion possibly because he was a car salesman. His license was not even cancelled. He cannot be dealt with in that way 011 this occasion. Robinson was sentenced to in davs' imprisonment ami his license was tan celled for IS months.
