THREE WILLS.
COURT ACTION SETTLED
The action before Mr. Justice Ostler in the Supreme* Court to determine which of three wills and codicils should he admitted for the purposes of probate in the estate of the late Mr. Henry dames Babe, of Whangarei, concluded abruptly yesterday afternoon in a settlement which was indicated when his Honor, after the evidence of the first two witnesses; for the plaintiff had been heard, intimated that he would like to see counsel in chambers. Plaintiff was James F. S. Briggs, solicitor, of Whangarei (Mr. T. Henry), who was sole executor and trustee under the secoifd of the wills, merely a revised draft of the first one. and who witnessed three codicils later, one of which revoked a will made later, in which P. P. Skelton and G. H. R. Skelton were appointed executors and trustees. Defendants were the various legatees (represented by Mr. A. K. North, Mr. R. P. Council and Mr. Urquhart). and P; P. and G. H. R. Skelton (Mr. North). The widow and Messrs. Skelton claimed that at the time of executing the codicils, when he was in hospital, the testator had no testamentary capacity, and that the latest will should be admitted.
