SECOND TRIAL.
STILL NO AGREEMENT.
FURTHER HEARING ORDERED.

DUNEDIN, Monday.
The retrial of George Albert Terry on a charge of negligently driving a car and causing the death of Douglas Haig Gutsell was held in the Supreme Court to-day. When the case was first heard on February 7 the jury was unable to reach an agreement, and the Chief Justice, Sir Michael Myers, discharged the jurv and ordered a new trial. A" repetition of the evidence given in the first hearing was heard to-day. Evidence for the defence was given by accused.
After a retirement of five and a half hours the jury reported that it was unable to agree on a verdict. Mr. Adams moved for a new trial, which his Honor ordered for the next session of the Supreme Court. Bail was allowed as formerly.
