DID NOT ANSWER BAIL Believed to have been drowned, a man who failed to anewer to the bail upon which he had been released, and whose clothes were found on the beach at Balena Bay, Wellington, some weeks ago, was arrested on a Bench warrant in Auckland last night by Detective Snunders. Levien, (S.M., in the Police Court on a charge which sot out that at a sitting of the Supreme Court at Wellington on February 1 last, an indictment vtns presented by the Grand Jury against him on a charge of committing an offence againet a male. Detective-Sergeant MeHugh asked that Heaven should be remanded to appear in the Police Court at Wellington to-morrow at 10 a.m. The remand was granted. On Wednesday. February 1, reference to the charge againet Heaven was made in the Supreme Court at Wellington, when he failed to answer his bail. He was to have appeared at the criminal sessions on four charges of committing offences against males. The Crown Prosecutor, Mr. W. S. Cunningham, said one of the conditions of Heaven's release upon bail was that Ihe should report to the police daily. A towel and clothing, which had been identified as his, had been found on the beach at Balena Bay, Wellington, some weeks ago, and nothing had been heard from him since. Mr. Cunningham made formal application for a Bench warrant for Heaven's arrest, and he also asked that the bail bonds be certified as estreated. Counsel Hit id he had been briefed to represent accused. He had received from accused after his vacation letters written during the vacation, but accused was now believed to have been drowned. Mr. Justice Blair issued the Bench warrant and the question of bail was deferred.
