£2879 DAMAGES CLAIM. After the case for the defence had been ojKMied yesterday afternoon the hearing of a claim for £2.100 jreneral and £379 special damages arising >ut of a collision between two motor car's on the Auckland-Waiwera road near Hadtield's Beach, on December 2li, 1037. was adjourned until Monday afternoon. The claim was heard before Mr. Justice Fair and a jury. The plaintiff was Arthur Rupert Brunton. of Northcote, baker (Dr. McElroy), and the defendant was Algar Walter Ferguson, of Auckland, motor car salesman (Mr. Richmond). Plaintiff claimed that hi* arm had been so injured that he would not be able to carry on his old occupation or any other requiring the use of both arms, and that his injuries had been due to defendant's careless driving. Defendant denied negligence and alleged that the accident was due to plaintiff's own negligence. Plaintiff gave evidence yesterday and another witness, Frank Pearce. estimated the speed of defendant's car when it passed him. at about 60 miles an hour. After Mr. Richmond had opened the case for the defence, the Court adjourned until Monday afternoon.
