APPEAL FAILS.

In the case of Alexander John Hopkirk versus Ellen Dawson, the Court of Appeal refused an application for conditional leave to appeal to the Privy Council from a judgment of the Court of Appeal refusing a new trial of the action. At the trial of the action, before Mr. Justice Fair and a jury last November, his Honor entered judgment for the respondent for £151 and costs. Hopkirk appealed for a new trial, which was refused by the Court of Appeal. It was ajrainst this decision that Hopkirk again appealed, seekinjr leave to take the case to the Privy Council.
