OPOTIKI DAMAGE® CLAIM.
After having heard argument on the motion by To \N haka Waiapu 'Mr, Richmond") for a new trial of a damages claim in which a jury had awarded David Mikaere £300 general and £14K 7/(5 special damages agianst Waiapu. his Honor, Mr. Justice* Callan, reserved decision. The claim aroae from an accident on Hukumoa Hill, near Opotiki, in which Mikaere, a passenger on a motor truck driven by Waiapu, suffered injury to an elbow n« the truck passed clos« bv another truck driven by Alfred W. Ruff. After Mr. Richmond had moved for a new trial, Mr. Hodgson, for Mikaere, traversed the evidence to emphasise that in all the circumstances disclosed there must have been negligence on wliirh the liiry were justified in finding as they did.
