THE APPEAL HEARD. MATTER REFERRED BACK. (From Our Own Correspondent.) CHRISTCHURCH, this day. The appeal of Mr. H. Stafford, owner ot Pot Luck, against the decision of the judicial committee of the Metropolitan Trotting Club in dismissing? his protest against V. Scott, winner of the third heat nt the Third Qualifying Event at the interDominion championships, was heard in
committee by the Board of the Xew Zealand Trotting Association yesterday, when ! it was decided to refer the matter back to the club. i
U. Scott finished first in the Third Qualifying Event of the inter-Dominion championship, Pot Luck being second and ! Supertax third. Previous to the race. Mr. .T. H. McKenzie, owner of L*. Scott, had applied for pel mission to make a change ol gear on his horse, namely, to race in a closed bridle, instead of the open one he had carried on the previous days. Alter L*. Scott had finished first. Mr. H. Staffoid entered a protest on the grounds that Hule 282 regarding a change of gear had not been complied with.
A meeting of the judicial committee was held after the race and adjourned until the following day when the p: latest was dismissed. Air. Stafford then appealed to the Xew Zealand Trotting Association, but in the meantime the dividends had been paid out on 1". Scot; as the winner and on Pot Luck and Supertax as place-getters. Roi I'Or was fourth.
Rule 282. on which Mr. Stafford based his appeal, is as follows:—"Subject to the provision* set out later in this rule in regard to the use of hopples, should a horse race with or without shoes, overcheck and/or other gear in a race at a meeting, such horse in any subsequent race at such meeting shall race with the same kind of gear, unless the express consent of the stewards to any change of gear is first obtained \ny permission so given for such a horse to race with or without hopples or to make a
change of any gear on a horse shall Up publicly announced on tlie course before the race in which tlie horse may be competing and not later than five minutes before the opening of tlie totalisator lor such race."
