POSSESSION OF HOUSES.

MAGISTRATE'S DECISION'S. (From Our Correspondent.) WHAKATANE, Tuesday. Case* Involving the possession of houses were heard before Mr. E. L. Walton, S.M., at the Whakatane Magistrate's Court to-day. One case was brought by Moses Penny against Evan Hunter. Mr. B. S. Barry, for the plaintiff, said' he had bought the house and had asked Hunter to vacate it as soon as possible. Penny had secured a house for Hunter and had paid rent to keep it available. Hunter declined to use the house, saying it did not suit him.

Mr. <». Otley, for the defendant, said that his client only wanted time to find another house. His wife was in delicate health and the property offered was not suitable.

The magistrate made an order for possession by February 7, 1938, with costs against defendant.

The other case was brought by Kathleen E. Right, for possession of a house owned by her at Ohope Beach. She wished to live in the house herself. She said she let the house to (Jeorge Taylor at a rental of 17/« a week. Taylor "had disappeared and left two people in the house who had no right to be there. She had taken no rent from them.

Mr. B. S. Barry said the two persona in the house claimed to be guests of Taylor and refused to go. An order for possession was made, with judgment for £7 for rent due.
