INTOXICATION CHARGE.
MOTOEIST FINED £4. As a result of a slight collision with a traincar in Khyber Pass Road about 5.40 p.m. on June 14, William Sullivan, aged 39, a plasterer, who was arrested for being in a state of intoxication while in charge of a motor car, appeared in the Police Court before Mr. W. R. McKean, S.M. He pleaded guilty to the charge. Sub-Inspector Fox said only slight damage was done to the tram, a step being split in two. The motornian asked Sullivan for his name and address, but this request was refused. Two constables then appeared and they noticed that Sullivan was under the influence of liquor, although not drunk. Shortly after 6 p.m. he was examined by a doctor who certified that it was unwise for Sullivan to be driving a car because of his condition. Nothing was previously known against Sullivan.
Mr. Spencer Mason, who appeared for Sullivan, submitted that the report of the examining doctor showed the case was more or less a borderline case. Sullivan was unable to obtain the services of his own doctor until over two hours after his arrest, which precluded him from contesting the matter. Counsel added that the report «lid not say Sullivan was incapable of driving. He had done what many sober motorists often did—turned out too sharply from tne kerb to avofel another car, and unfortunately caine into slight collision with a tram. Sullivan, who wa» a married man, suffered from malaria contracted while on active service.
Remarking that although the evidence showed Sullivan was only in a mild state of intoxication, Mr. McKean said he was not a fit person to be in charge of a car. anil imposed a fine of £4. Sullivan's driving license was cancelled for twelve months.
