WOMAN'S CLAIM- FOR £1003.
DECISION FOR INDIAN,
The claim for £1003 for board, lodging and nursing services, brought by Mrs. Lucy Matutinovicli against an Indian, M. A. Sunni, formerly a wellknown wrestler, was concluded at the Supreme Court yesterday afternoon. His Honor Mr. Justice Callan held that Mrs. Matutinovich had failed to prove her claim, and decided in favour of the defendant.
Ihe plaintiff alleged that Sunni hoarded at her house over a period of five years commencing in 1929, that he was continually in ill-health, and that she nursed liim throughout the period. His Honor said that the Court was in the awkward position of having to adjudicate on a very stale claim, a rather improbable claim, and a vigorously defended claim. The onus was on the plaintiff to prove her allegations, and this she had failed to do. If the plaintiff had a good ease, she had "made a mess of it" by grossly exaggerating it. She must totally fail in the action, and judgment would be for the defendant. Costs were not asked for by Mr. Bennett, who appeared for the defendant. Mr. Slipper represented the plaintiff.
