CHARGE OF INTOXICATION.

R. Mckean, S.M., entered a conviction and fined Hansen £20 The magistrate also cancelled accused's license for six months. Mi. A. Hall .Skelton, who appeared for accused, said Hansen had been for six years employed as a transport truck driver and was known as a hard working, temperate man who had never been in any trouble before. Hanseq, considered that he was quite sober. Evidence was called in support of counsel's submission*. Hansen, in evidence, considered that he must have fallen asleep while driving in Karangahape Road shortly after 4 p.m. on I-ebruarv 14. He woke up, he said, when the car struck the kerb. "All I have heard from the defendant is that he was a tired man at an earlv hour of the morning and that he had consumed two glasses of beer some time before his arrest." said the magistrate. 'What took place suggests that he really was in the condition described by witnesses. I have not the sllehtest doubt that he was under the influence of liquor. In so many of these T am told that a state of intoxication is induced bv some very small quantity of liquor. Tf this is so in this case, it had an effect that I would not have anticipated." Upon the magistrate announcing his decision. Mr. Skelton asked that security for appeal should be fixed, as he intended to appeal. The magistrate fixed security at £7 7/. plus the amount of the fine and ' expenses, €2 1/.
