DECREE VOID.
DIVORCE PETITION. AGREEMENT NOT DISCLOSED. ADMISSION OF FACTS. i An application that a decree nisi made by the Court on February 27 last be annulled and that the petition be dismissed, was before Mr. Justice Johnston in the Supreme Court this morning. The parties concerned in the petition in divorce were Martin Bilicli White and Mary Georgia Bilicli White, and in February last, on the petition of the husband, a decree nisi was granted 011 the ground that the wife had failed to comply with an order for restitution of conjugal rights. Subsequently the Solicitor-General intervened, and in the application for rescission of the decree nisi this morning was represented by Mr. V. li. Meredith. Mr. Meredith said all the facts were admitted, and it was not necessary to call evidence. In view of the fact that an agreement o* separation then in existence was not placed beforo the Court, the decree nisi had to go. His Honor said he understood the facts. The decree nisi would be annulled and the petition dismissed.
