CYCLIST'S INJURIES. | COLLISION WITH LORRY. QUAY STREET HAPPENING. Damages to the extent of £<SSS 6/5 were claimed in the Supreme Court to-day by Valentine Dunne (Mr. Bone), superintendent for mails at Auckland, from Winstone Limited (Mr. Holmden), in consequence of injuries he received in June, 1035, when one of the defendant's motor lorries collided with him while riding a bicycle in Quay Street. The plaintiff was riding along Quay Street, and the lorry was coming from Britomart Place into Quay Street. The result of the collision, which plaintiff alleged was due to the negligent driving of the lorry, was that the plaintiff sustained injuries to his right elbow and various parts of his light leg from the hip to the ankle. He was totally incapacitated for 11 weeks, and claimed that he had suffered permanent injury to his right foot and ankle. The claim comprised £750 general damages and £138 0/5 special, of which £84 was for loss of wages. Plaintiff was riding towards the city about 4ft from the kerb, and observed the lorry on his left as he was crossing the intersection, said Mr. Bone. The lorry driver put up his hand indicating to plaintiff that he intended to stop. At the same time the lorry reduced speed. When plaintiff got just past the silent policeman, at the intersection, and the lorry was about 12ft away, plaintiff realised that the lorry was not going to stop. He swerved to the right, away from the lorry, but the collision occurred, the rear wheel of the bicycle being struck by the front left-hand wheel of the lorry. A lorry driver, an independent witness, would state that the driver of defendant's lorry made no deviation from his straight-ahead track, added, counsel. The plaintiff, in evidence, said the lorry driver gave a sign which led him to believe that he had a clear passage across the road. Cross-examined, plaintiff said that he had commenced proceedings in the Magistrate's Court, and claimed £100 for general damages. Four days before the case was to be heard he consulted another doctor, and he then realised the gravity of his injury. Medical evidence as to the extent of plaintiff's injuries was given by Dr. C. E.
